13. Arbitration Agreement

IF YOU ARE LOCATED IN THE UNITED STATES, YOU AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, OR ANY SERVICES PROVIDED BY LAW BADGERS PLLC (EXCLUDING DISPUTES RELATING TO THE ENFORCEMENT OR VALIDITY OF INTELLECTUAL PROPERTY RIGHTS) SHALL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION BEFORE A NEUTRAL ARBITRATOR SELECTED BY LAW BADGERS PLLC. YOU AND LAW BADGERS PLLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU ACKNOWLEDGE AND AGREE THAT YOU AND LAW BADGERS PLLC ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND TO PARTICIPATE IN A CLASS ACTION.

The arbitration shall be conducted in Maricopa County, Arizona, before a neutral arbitrator selected by Law Badgers PLLC. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.

This arbitration agreement does not apply to any claims you may have arising from personal injury, wrongful death, or other tort claims related to legal services provided by Law Badgers PLLC pursuant to a signed engagement agreement. This arbitration agreement applies solely to disputes regarding the use of the Website and these Terms.

14. Communications via Text, Email, and Phone

By providing your phone number or email address through our contact form, live chat, or any other means, you consent to receiving communications from Law Badgers PLLC, including but not limited to phone calls, text messages (SMS), and emails. Such communications may include responses to your inquiry, case-related updates (if you become a client), appointment reminders, and informational or marketing communications about our legal services.

You acknowledge that you are not required to consent to receive promotional communications as a condition of obtaining legal services. Standard message and data rates applied by your wireless carrier may apply to text messages we send you.

15. Confidentiality of Internet Communications

Information sent to Law Badgers PLLC via Internet email, the Website contact form, or the live chat feature is transmitted over a non-secure medium. While we use encrypted connections (HTTPS/TLS) to protect data in transit and make reasonable efforts to keep communications private, because of the nature of Internet communications and the absence of an attorney-client relationship (which is only established through a signed engagement agreement), we cannot guarantee absolute confidentiality of information transmitted through these channels.

16. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to these Terms or the Website shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Subject to the arbitration agreement in Section 13, any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction and venue of such courts.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Law Badgers PLLC regarding the use of the Website and supersede any prior agreements or understandings.
