After a car accident, you need medical treatment — but you may not have health insurance, or you may not be able to afford the copays and deductibles. That’s where medical liens come in.

How Medical Liens Work

A medical lien — sometimes called a letter of protection (LOP) — is an agreement between your attorney, you, and a medical provider. The provider treats you now and agrees to wait for payment until your case settles. In exchange, the provider gets a guaranteed payment from the settlement proceeds.

This allows you to get the treatment you need without paying out of pocket during your case. The provider accepts the risk that they’ll wait for payment in exchange for the certainty that they’ll be paid from the settlement.

Why This Matters

Insurance companies watch your medical treatment closely. Gaps in treatment — weeks or months where you didn’t see a doctor — give them ammunition to argue you weren’t really hurt. A medical lien ensures you can get consistent, uninterrupted treatment regardless of your financial situation.

The Catch

Medical liens reduce your net settlement because the provider’s bill comes off the top. Your attorney should negotiate these liens down wherever possible — many providers will accept less than the full billed amount in exchange for prompt payment at settlement.

Health Insurance vs. Medical Liens

If you have health insurance, you should generally use it first. Your health insurance company’s negotiated rates are usually lower than what a lien provider charges. However, your health insurer may assert a subrogation right — a claim to be repaid from your settlement for the treatment they covered. Your attorney manages this too.
