Traumatic Brain Injury After a Car Accident — Arizona Legal Guide
Traumatic brain injury (TBI) is one of the most life-altering consequences of a car accident. It ranges from mild concussions to severe brain damage that permanently changes who you are. And it’s far more common than most people realize.
Types of TBI
Concussion (mild TBI). The most common form. Symptoms include headache, confusion, memory problems, dizziness, and sensitivity to light and noise. Most concussions resolve in weeks to months — but some lead to persistent post-concussion syndrome lasting a year or more.
Moderate TBI. Loss of consciousness lasting minutes to hours, persistent confusion, and cognitive difficulties. May require rehabilitation.
Severe TBI. Extended unconsciousness or coma, permanent cognitive impairment, personality changes, and physical disability. Severe TBI can require lifetime care.
The Hidden Injury
TBI is called the “invisible injury” because it doesn’t always show on initial imaging. CT scans in the ER may come back normal even when significant brain injury has occurred. MRI is more sensitive but still misses some injuries. Neuropsychological testing is often needed to document the full extent of cognitive impairment.
Why TBI Cases Are High-Value
The lifetime cost of a severe TBI can exceed $1 million — including acute medical care, rehabilitation, long-term therapy, lost earning capacity (often permanent), home modifications and assisted living, and the profound impact on quality of life.
The Insurance Company’s Playbook
Insurance companies aggressively fight TBI claims. They’ll argue the TBI was pre-existing, the symptoms are exaggerated, the cognitive deficits existed before the accident, or you didn’t lose consciousness so it can’t be that serious. Every one of these arguments can be countered with proper medical evidence and expert testimony.
