Whether it’s a holiday barbecue, a Super Bowl watch party, or just a weekend gathering, hosting a house party in Arizona comes with legal responsibilities you should understand — especially if alcohol is involved.

Social Host Liability in Arizona

Arizona’s Dram Shop Act applies to licensed establishments, not private social hosts. This means you generally cannot be sued under the Dram Shop Act for serving alcohol to an adult guest who then causes an accident.

However, you are not completely off the hook.

When You CAN Be Liable

Serving minors. Under A.R.S. § 4-301, furnishing alcohol to anyone under 21 is illegal. If you serve minors at your party and one of them causes an injury — to themselves or others — you face both criminal charges and civil liability. This is one of the most common sources of social host lawsuits.

Premises liability. As a property owner, you have a duty to maintain reasonably safe conditions for your guests. If someone is injured due to a hazard on your property — a broken step, a slippery pool deck, an unsecured trampoline, a dog bite — you could be liable under standard premises liability principles.

Negligent entrustment. If you know a guest is severely intoxicated and you hand them car keys, help them to their car, or otherwise facilitate their driving, you could be found negligent if they cause an accident.

Protect Yourself

Plan transportation options for guests who’ll be drinking. Consider rideshare, designated drivers, or overnight accommodations. Never serve alcohol to anyone under 21 — period. Maintain your property and address hazards. Don’t let visibly intoxicated guests drive.
