Football, Beer, and Phoenix DUIs — Watch Yourself

DUI

It’s that time of year. Weekends are all about football. Whether you’re tailgating at State Farm Stadium, watching at a sports bar, or hosting a watch party at home, nothing goes with football better than snacks and beer. But before you get behind the wheel after the game, you need to understand how seriously Arizona takes DUI.

Arizona’s DUI Laws Are Among the Toughest in the Nation

Arizona has a tiered DUI system under A.R.S. § 28-1381 through 1383:

Standard DUI (.08-.149 BAC) — Class 1 misdemeanor. Minimum 10 days jail (9 suspended with treatment), $1,250+ in fines, ignition interlock device, license suspension, and alcohol screening.

Extreme DUI (.15-.199 BAC) — Enhanced penalties including minimum 30 days jail, $2,500+ in fines, and longer ignition interlock requirements.

Super Extreme DUI (.20+ BAC) — Minimum 45 days jail, $3,250+ in fines, and the most restrictive interlock requirements.

Aggravated DUI — A felony. Applies to third offenses within 7 years, DUI with a suspended license, DUI with a minor in the vehicle, or DUI while on an ignition interlock device.

If a Drunk Driver Hits You

If you’re injured by a drunk driver — whether they’re coming from a tailgate, a bar, or a house party — you have a personal injury claim against the driver. Because DUI is a criminal violation, it establishes negligence per se. You may also be entitled to punitive damages because drunk driving is a conscious, reckless choice.

Additionally, investigate where the driver was drinking. Under the Dram Shop Act, a bar or restaurant that served an obviously intoxicated person may share liability.

The Bottom Line

Enjoy the game. Enjoy the beer. But plan your ride home before the first snap. Rideshare, designated drivers, or just crash on your buddy’s couch. Arizona doesn’t mess around with DUI — and neither do the Law Badgers when our clients are hurt by drunk drivers.
